Please read these Terms and Conditions carefully before using AfrikCap's services. By accessing or using our platform, you agree to be bound by these terms.
1Acceptance of Terms
By accessing or using AfrikCap's services, website, or platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree to these terms, you must not use our services.
2Service Description and Important Disclaimers
AfrikCap Limited operates as a loan sourcing and facilitation platform in Uganda. We connect small retailers, micro-enterprises, and SMEs with licensed financial institutions for working capital loans.
Critical Disclaimers
- AfrikCap is NOT a lender. We do not provide loans directly.
- AfrikCap does NOT hold or disburse funds. All fund transfers occur directly between you and the lending institution.
- All loan decisions are made independently by licensed financial institutions based on their own credit evaluation criteria.
- Loan terms, interest rates, and conditions are determined solely by the lending institution, not AfrikCap.
3No Guarantee of Loan Approval
Submitting an application through AfrikCap does not guarantee loan approval. Credit decisions are made independently by our lending partners based on their criteria, which may include but are not limited to:
- Credit history and creditworthiness assessment
- Business performance and financial health
- Collateral availability (if required)
- Regulatory compliance requirements
- Internal risk assessment policies
AfrikCap makes no representations or warranties regarding the likelihood of loan approval.
4User Responsibilities and Information Accuracy
By using our services, you represent and warrant that:
- You are at least 18 years of age and legally capable of entering into binding contracts
- All information you provide is accurate, complete, and truthful
- You will promptly update any information that becomes inaccurate
- You are the owner or authorized representative of the business applying for financing
- You will not submit fraudulent, misleading, or false applications
- You will not use our services for any illegal or unauthorized purposes
Information Accuracy Responsibility: You bear full responsibility for the accuracy of all information provided. Providing false or misleading information may result in application rejection, account termination, and may constitute fraud under Ugandan law.
5Fees and Charges
AfrikCap's services are free of charge for applicants. We do not charge any upfront fees, application fees, or processing fees to borrowers.
We receive commissions from lending partners upon successful loan disbursement. These commissions are paid by the lenders and do not affect the loan terms offered to you.
Warning: If anyone claiming to represent AfrikCap asks you for upfront payment, this is fraudulent. Please report such incidents to us immediately.
6Limitation of Liability
To the maximum extent permitted by law:
- AfrikCap is not liable for any decisions made by lending partners regarding loan approval, rejection, or terms
- AfrikCap is not liable for the loan terms, interest rates, fees, or conditions offered by lending institutions
- AfrikCap is not liable for any disputes, defaults, or issues arising between you and the lending institution
- AfrikCap is not liable for any direct, indirect, incidental, consequential, or punitive damages arising from use of our services
- AfrikCap is not liable for any losses resulting from inaccurate information provided by you
Our total liability for any claim shall not exceed UGX 100,000 (One Hundred Thousand Uganda Shillings).
7Intellectual Property
All content on the AfrikCap platform, including but not limited to text, graphics, logos, trademarks, and software, is the property of AfrikCap Limited or its licensors and is protected by intellectual property laws.
You may not reproduce, distribute, modify, or create derivative works without our express written permission.
8Termination
We reserve the right to suspend or terminate your access to our services at any time, without prior notice, for any reason, including but not limited to:
- Violation of these Terms and Conditions
- Provision of false or fraudulent information
- Suspected illegal activity
- Request by law enforcement or regulatory authorities
9Dispute Resolution
In the event of any dispute arising out of or relating to these Terms and Conditions or our services:
- Amicable Resolution: The parties shall first attempt to resolve the dispute amicably through good faith negotiations within 30 days
- Mediation: If amicable resolution fails, the dispute shall be submitted to mediation under the rules of the Centre for Arbitration and Dispute Resolution (CADER) in Kampala
- Arbitration: If mediation fails, the dispute shall be resolved through binding arbitration in Kampala, Uganda
10Governing Law and Jurisdiction
These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of Uganda. Any legal proceedings arising from these terms shall be subject to the exclusive jurisdiction of the courts of Uganda.
11Amendments
AfrikCap reserves the right to modify these Terms and Conditions at any time. Continued use of our services after such modifications constitutes acceptance of the updated terms.
