1Who we are and what these terms cover

These terms govern use of AfrikCap's website, app and agent-assisted services. By using them you agree to these terms and to the Privacy Policy. AfrikCap Limited operates a loan marketplace: we collect and assess loan applications and connect applicants with licensed lending partners. AfrikCap is not a lender, does not hold or disburse funds, and is not a party to any loan agreement. If a lending partner approves your application, the lending relationship — including its terms, interest, fees and collections — is between you and that lender.

2Eligibility

  • You must be at least 18 years old and legally capable of contracting;
  • You must hold a valid Ugandan National ID (NIN) and be resident in Uganda;
  • Business loans require an operating business you are entitled to represent.

3Roles on the platform

  • Borrowers/applicants may submit applications (directly or through an agent), track their status, and receive lender decisions.
  • Field agents are authorised to collect applications on borrowers' behalf, verify identity documents, capture required photos/GPS with the borrower's knowledge, read the consent script aloud, and submit accurate data. Agents must complete a daily verified check-in before collecting or submitting borrower data.
  • Employees/loan officers review, score and allocate applications and manage platform operations.
  • Lending partners receive allocated applications, make independent credit decisions, and become responsible for the lending relationship on acceptance.

4Your information must be accurate

You warrant that everything you (or an agent on your behalf, from your answers) submit is true, complete and up to date. Submitting false information, another person's identity, or forged documents is grounds for immediate rejection, account suspension and, where appropriate, referral to authorities.

5Credit scoring and automated processing

Applications receive an automated assessment score used to prioritise and inform review. No application is finally rejected by the algorithm alone — scores support decisions by AfrikCap staff and lending partners. You may request human review of any assessment outcome by contacting support@afrikcap.com or asking your agent; a loan officer will re-examine the application and respond.

6Fees

Use of the AfrikCap platform to apply is free to borrowers unless expressly stated at the point of application. Lender interest and charges are set by the lending partner and disclosed in the loan offer.

[REVIEW] Confirm the fee structure: any origination/service fees charged by AfrikCap to borrowers or partners, and where they are disclosed.

7Acceptable use

  • No fraudulent, unlawful or deceptive activity, no impersonation;
  • No attempts to breach security, scrape data, reverse-engineer, or interfere with the service;
  • No use of another person's account; keep credentials confidential;
  • Agents: no collection of data beyond what the application requires, and no retention of borrower data outside the app.

8Agent obligations when collecting data in the field

  • Identify yourself as an AfrikCap agent and state the purpose of data collection;
  • Read the on-screen consent script to the applicant in a language they understand, and record only consents actually given;
  • Capture photos, documents and GPS only with the applicant's knowledge;
  • Complete the daily biometric check-in before starting work; never share devices or credentials;
  • Submit or sync collected data promptly; do not copy it elsewhere.

9Suspension and termination

We may suspend or terminate access for breach of these terms, suspected fraud, legal requirement, or risk to other users — with notice where practicable. You may stop using the platform at any time; data retention after closure follows the Privacy Policy's retention schedule.

10Limitation of liability

To the maximum extent permitted by Ugandan law: the platform is provided "as is"; AfrikCap is not liable for lending decisions made by lending partners, for indirect or consequential losses, or for losses caused by inaccurate information you supplied. Nothing in these terms excludes liability that cannot be excluded by law.

11Governing law and disputes

These terms are governed by the laws of the Republic of Uganda. Disputes should be raised with us first at support@afrikcap.com; if unresolved within 30 days, they shall be referred to the competent courts of Uganda.

[REVIEW] Decide dispute-resolution route: courts of Uganda vs. arbitration (e.g. CADER) and insert the chosen clause.

12Changes to these terms

We may update these terms; material changes are notified in the app and by email with the new version number and date. Continued use after the effective date constitutes acceptance; where the law requires fresh consent, we will ask for it explicitly.
