Terms and Conditions
01About AfrikCap
AfrikCap is a loan sourcing and facilitation platform operating in Uganda. We connect individuals and businesses with licensed banks, microfinance institutions and other regulated lenders. AfrikCap is not a lender. We do not approve, fund or disburse loans.
These Terms and Conditions ("Terms") govern your use of the AfrikCap website, forms, callback service and any application you submit through us or one of our field agents. By using our services you agree to these Terms.
02Who can use our services
- You are at least 18 years old and able to enter into a binding agreement.
- You are a resident of Uganda, or you represent a business registered in Uganda.
- You hold a valid National ID, or the business registration documents a lender may request.
- You are applying on your own behalf, or you are authorised to act for the business you name.
03What we do
When you use AfrikCap, we may:
- Run an eligibility pre-check based on the information you give us. The result is indicative only.
- Call you back to complete your application.
- Share your application with one or more licensed lenders whose products fit your request.
- Arrange a visit or call from an AfrikCap field agent where needed.
- Keep you updated on the status of your request.
04No guarantee of a loan
Submitting a pre-check, callback request or application does not mean you will receive a loan. Each lender carries out its own identity checks (KYC), credit assessment and affordability review, and makes its own decision. AfrikCap cannot influence or overturn a lender’s decision.
Indicative amounts, rates or timelines shown on our website are for guidance only and may differ from the offer a lender makes.
05Fees
AfrikCap does not charge borrowers any upfront fee to use the pre-check, request a callback or apply. If anyone asks you to pay money to AfrikCap to secure a loan, do not pay and report it to us at [email protected].
Lenders set their own interest rates, fees and charges. These must be disclosed to you by the lender before you accept an offer. AfrikCap may receive a commission from lenders for successful referrals; this does not change the price you pay.
06Your responsibilities
- Give complete, accurate and up-to-date information. False or misleading information may lead to your request being declined and may be reported to the relevant authorities.
- Read and understand the lender’s loan agreement before you sign it.
- Repay any loan according to the terms you agree with the lender.
- Do not use our services for fraud, money laundering or any unlawful purpose.
- Do not attempt to interfere with, copy or misuse the website or its systems.
07Your personal data
We collect and process personal data in line with the Data Protection and Privacy Act, 2019 and its regulations. We only share your information with lenders and service providers needed to process your request, and only with your consent.
You may ask to access, correct or delete your personal data at any time. See our Privacy Policy and Data Protection notice for full details.
08Lending partners
Our lending partners are independent, licensed financial institutions. Any loan you take is a contract between you and that lender, governed by the lender’s own terms and conditions. Questions about repayments, statements or disputes on an active loan should go to the lender first. We will help where we can.
09Intellectual property
The AfrikCap name, logo, website content and design are owned by AfrikCap or its licensors. You may not copy, reproduce or use them for commercial purposes without our written permission.
10Limitation of liability
We work hard to keep our services accurate and available, but we provide them "as is". To the extent permitted by law, AfrikCap is not liable for any lender’s decision, for the terms of any loan, or for indirect or consequential loss arising from your use of our services. Nothing in these Terms limits any rights you have under Ugandan consumer protection law.
11Changes to these terms
We may update these Terms from time to time. The "Last updated" date at the top of this page shows when they last changed. If a change materially affects you, we will let you know by SMS, email or a notice on the website. Continuing to use our services after an update means you accept the new Terms.
12Governing law
These Terms are governed by the laws of the Republic of Uganda. Any dispute that cannot be resolved by contacting us first will be handled by the courts of Uganda.
13Contact us
